These Terms govern your use of LeadlyIVR (the “Service”), operated by [Company Legal Name], [Registered Address], India (“we”, “us”). By creating an account or using the Service you agree to these Terms.
1. The Service
LeadlyIVR is a cloud telephony / IVR platform that lets businesses configure call menus, route calls to agents, rent virtual phone numbers, and record and analyse calls. Telephony is provided through our carrier partner (Plivo); payments are processed by Razorpay. We are a software layer on top of these providers.
2. Eligibility & accounts
You must be a business or authorised representative, 18+, and able to form a binding contract under Indian law. You are responsible for your account credentials, your agents’ use, and all activity under your account.
3. Acceptable use
You agree not to use the Service for unlawful, fraudulent, or abusive purposes, including unsolicited telemarketing or messaging in violation of TRAI/DLT regulations, impersonation, or sharing of unlawful content. You are responsible for obtaining caller consent (including for call recording) where required by law.
4. Phone numbers & KYC
Virtual numbers are rented from our carrier and remain subject to the carrier’s and regulator’s terms. Indian numbers require completed KYC/compliance before activation. Numbers may be reclaimed if rental lapses or compliance is not met. Number rentals are non-refundable once provisioned.
5. Plans, billing & taxes
Paid plans are billed in advance (monthly or annual) at the prices shown at checkout, exclusive of GST. Usage beyond included minutes may be billed as overage. Fees are charged via Razorpay. Failure to pay may result in suspension. See our Refund & Cancellation Policy.
6. Third-party services
The Service depends on Plivo (telephony) and Razorpay (payments). Their availability, terms, and pricing are outside our control, and your use is also subject to their terms.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. The Service is provided “as is” without warranties except as required by law.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the [3] months preceding the claim. We are not liable for indirect or consequential losses.
9. Termination
You may cancel anytime (see Refund Policy). We may suspend or terminate accounts for breach of these Terms. On termination, your numbers may be released and data deleted per our retention policy.
10. Governing law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of [City, State].
11. Changes
We may update these Terms; material changes will be notified. Continued use constitutes acceptance.
